Like many local authorities and housing associations Southwark Council has historically collected water charges on behalf of Thames Water for most of the tenancies under its management. A recent court case however ruled that technically Southwark acted as “water seller” as opposed to an agent for the water authority (see the pdf attachment below for full details). As a result the Council has been refunding tenants who held a tenancy between 1st April 2001 and 28th July 2013.
Tenants or former tenants of properties directly managed by Southwark have been receiving refunds over the past few weeks. Southwark however has not yet processed rebates for tenants/former tenants living in tenant managed properties such as Leathermarket JMB.
JMB tenants will however be receiving rebates based on the Southwark calculation. The JMB is currently awaiting a cheque from the Council to cover the rebates due to its residents. Once this funding is received the JMB will distribute rebates as soon as possible.
Please note that any rent arrears outstanding as at 3 July 2016 will be deducted first, in line with the council’s directly managed tenants.
